NestStay is an online marketplace that connects Hosts offering short-term accommodation with Guests seeking accommodation.

NestStay provides the technology to facilitate bookings but is not:

• the owner, manager or operator of any property;
• a travel agency;
• an estate agent;
• a property management company; or
• a party to the accommodation agreement between Hosts and Guests.

Every booking forms a separate contract directly between the Host and the Guest.

To use the Platform you must:

• be at least 18 years of age;
• have the legal authority to enter into binding contracts;
• provide accurate and truthful information;
• comply with all applicable laws.

NestStay reserves the right to suspend or terminate any account that fails to meet these requirements.

You agree to:

• maintain accurate account information;
• keep your password confidential;
• notify NestStay immediately if you suspect unauthorised access to your account;
• accept responsibility for all activity carried out through your account.

Hosts are solely responsible for their listings and properties.

Hosts agree to:

• ensure all listing information is accurate;
• upload truthful photographs;
• provide safe, clean and legal accommodation;
• comply with all planning, licensing, tax and safety laws;
• maintain appropriate insurance;
• honour confirmed bookings except where cancellation is permitted.

Hosts are solely responsible for the condition, maintenance and operation of their property.

Guests agree to:

• follow all house rules;
• respect neighbours;
• keep the property secure;
• leave the accommodation in a reasonable condition;
• report damage immediately;
• avoid unlawful, dangerous or disruptive behaviour.

Guests are responsible for the conduct of anyone accompanying them during their stay.

Hosts are responsible for all listing content.

Listings must not:

• contain misleading information;
• infringe intellectual property rights;
• advertise illegal accommodation;
• contain offensive or unlawful material.

NestStay may remove, edit or suspend any listing at its sole discretion.

A booking becomes legally binding only when:

• payment has been successfully processed; and
• a booking confirmation has been issued.

Hosts should not cancel confirmed bookings except where unavoidable circumstances apply.

Payments are processed through authorised third-party payment providers.

Guests agree to pay all applicable charges, including:

• accommodation costs;
• cleaning fees;
• service fees;
• security deposits;
• taxes where applicable.

Host payouts are made according to NestStay's published payment schedule.

NestStay may charge service fees to Hosts, Guests or both.

All applicable fees will be displayed before payment is completed.

Cancellation policies are selected by the Host and displayed on each listing.

Refunds are subject to:

• the Host's cancellation policy;
• applicable consumer protection laws; and
• any overriding legal requirements.

NestStay reserves the right to cancel bookings where necessary for safety, fraud prevention or legal compliance.

Where applicable, Hosts may require a security deposit.

Security deposits may be used to cover:

• accidental damage;
• malicious damage;
• missing items;
• excessive cleaning;
• breaches of house rules.

Damage disputes remain between the Host and Guest.

Guests and Hosts may leave honest reviews.

Reviews must not:

• contain false information;
• include abusive language;
• contain threats;
• reveal confidential or personal information;
• be used to pressure another user.

NestStay may remove reviews that breach these Terms.

NestStay may request identity verification at any time.

Failure to complete verification may result in:

• booking cancellation;
• listing removal;
• account suspension; or
• permanent account closure.

Users must not:

• commit fraud;
• manipulate reviews;
• create fake accounts;
• avoid Platform fees by arranging bookings outside NestStay after initial contact through the Platform;
• upload malicious software;
• harass other users;
• use stolen payment methods;
• advertise properties they are not authorised to rent;
• breach applicable laws.

NestStay may immediately suspend or permanently terminate any account engaging in prohibited conduct.

Hosts are responsible for arranging suitable insurance for:

• buildings;
• contents;
• public liability;
• landlord or holiday-let cover where appropriate.

Guests are strongly encouraged to obtain travel insurance covering cancellations, medical expenses and personal belongings.

NestStay does not provide insurance unless expressly stated.

Hosts remain solely responsible for reporting and paying all taxes relating to their listings.

Guests are responsible for paying taxes displayed during checkout.

All Platform content, including logos, branding, software, graphics, text, databases and website design, belongs to NestStay or its licensors.

No content may be copied, reproduced or distributed without written permission.

Our collection and processing of personal information is governed by the NestStay Privacy Policy.

By using the Platform you consent to our handling of your personal data in accordance with applicable data protection legislation.

NestStay may integrate with third-party services including payment providers, identity verification providers, mapping services and messaging services.

NestStay is not responsible for the availability, security or performance of third-party services.

NestStay acts solely as a technology platform connecting Hosts and Guests.

NestStay does not inspect, own, manage, supervise or control listed properties.

NestStay makes no guarantee regarding:

• property quality;
• cleanliness;
• legality;
• suitability;
• safety;
• availability; or
• accuracy of listings.

Guests book accommodation entirely at their own risk.

To the fullest extent permitted by law, NestStay shall not be liable for:

• any loss, theft or damage to a Host's property;
• any loss, theft or damage to a Guest's belongings;
• damage caused by Guests, Hosts or third parties;
• personal injury, illness or death occurring during a stay unless directly caused by NestStay's own negligence where liability cannot legally be excluded;
• disputes between Hosts and Guests;
• cancellations by either party;
• inaccurate property descriptions;
• acts, omissions or misconduct of any user;
• loss of profits, revenue, business opportunities or goodwill;
• indirect, incidental, special or consequential damages.

NestStay provides only the online marketplace through which bookings are made.

Hosts acknowledge that they remain solely responsible for protecting their own property, maintaining suitable insurance and recovering losses directly from Guests where appropriate.

Guests acknowledge that they are solely responsible for any damage, theft, excessive cleaning costs or losses they cause during a stay.

NestStay is under no obligation to investigate, resolve or compensate either party in relation to disputes, although we may choose to assist at our sole discretion.

Nothing in these Terms excludes liability that cannot lawfully be excluded under the laws of England and Wales.

You agree to indemnify and hold harmless NestStay, its directors, employees, contractors and affiliates from all claims, liabilities, damages, costs and legal expenses arising from:

• your use of the Platform;
• your breach of these Terms;
• your breach of applicable law;
• your infringement of another person's rights.

NestStay shall not be liable for any failure or delay caused by circumstances beyond our reasonable control including natural disasters, pandemics, government restrictions, war, terrorism, industrial disputes, internet failures or power outages.

NestStay may suspend or terminate any account where:

• these Terms are breached;
• fraudulent activity is suspected;
• users pose a safety risk;
• repeated justified complaints are received;
• required verification is not completed.

Listings may also be removed without notice.

Hosts and Guests should attempt to resolve disputes directly.

NestStay may, but is not obliged to, assist with communication between users.

NestStay is not an arbitrator and accepts no responsibility for determining fault or awarding compensation.

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales unless mandatory law provides otherwise.

NestStay may amend these Terms at any time.

Updated versions will be published on the Platform.

Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
